Terms & Conditions of Sale

1. Introduction

These Terms & Conditions govern the sale of all products purchased through the Balsan & Capel website. By placing an order with us, you confirm that you have read, understood and agree to these Terms. If you have any questions, please contact our Customer Care Team before placing your order.

Balsan & Capel is a premium British menswear brand specialising in luxury clothing and accessories.

3. Placing an Order

When you place an order, you are making an offer to purchase our products. Your order is accepted only when:

  • payment has been successfully authorised
  • stock availability has been confirmed
  • you receive an Order Confirmation email.

If we cannot accept your order, we will notify you and issue a full refund. Reasons may include:

  • stock unavailable
  • pricing errors
  • payment failure
  • suspected fraud

4. Prices

All prices are shown in Pounds Sterling (£). Prices include VAT where applicable. Delivery charges are displayed during checkout. Prices may change without notice, however confirmed orders will not be affected.

5. Payment

We accept: Visa, Mastercard, American Express, Apple Pay, Google Pay and Shop Pay. Payment is taken when your order is confirmed.

6. Product Information

We strive to display colours and materials as accurately as possible. However, colours may vary depending on your screen settings. Measurements are approximate. Luxury fabrics may naturally vary slightly in texture or finish. These variations are not faults.

7. Delivery

United Kingdom
Standard Delivery: 2–5 Working Days
Express Delivery: 1–2 Working Days

International Delivery
Delivery times vary depending upon destination. Customers outside the UK are responsible for customs duties, import taxes and local handling charges.

8. Risk & Ownership

Ownership transfers once payment has been received in full. Responsibility for goods passes upon successful delivery.

9. Returns

You may return eligible items within 14 days of receiving your order. Returned items must be:

  • unworn
  • unused
  • unwashed
  • in original packaging
  • with all labels attached.

Returns that do not meet these conditions may be refused.

10. Non-Returnable Items

For hygiene reasons we cannot accept returns on underwear, socks, swimwear (where hygiene seals have been removed), personalised items and gift cards, unless faulty.

11. Faulty Items

If your item develops a manufacturing fault, please contact us immediately. Where a genuine fault is confirmed, we will offer a repair, replacement or refund in accordance with your statutory rights. Damage caused by misuse, accidental damage, incorrect washing or normal wear and tear is not considered a manufacturing fault.

12. Refunds

Approved refunds will be processed back to your original payment method within 14 days of receiving your returned goods. Original delivery charges are non-refundable unless the item is faulty or incorrectly supplied.

13. Order Cancellations

Orders may only be cancelled before dispatch. Once dispatched, orders must follow our Returns Policy.

14. Promotions

Promotional offers cannot be used together unless specifically stated. Discount codes cannot be applied after an order has been placed. Balsan & Capel reserves the right to withdraw promotions at any time.

15. Gift Cards

Gift cards cannot be exchanged for cash, cannot be refunded, and expire only where required by applicable law.

16. Intellectual Property

All content including logos, photography, product descriptions, graphics, branding and website design remain the exclusive property of Balsan & Capel. No material may be copied without written permission.

17. Privacy

Your personal information will only be processed in accordance with our Privacy Policy. We never sell your personal information.

18. Liability

Nothing within these Terms limits your statutory consumer rights. Our liability shall not exceed the purchase price of the goods supplied except where required by law.

19. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
